Terms of Service

1. Introduction

These Terms of Service (“Terms”) govern your use of the Learnfolio platform (“Platform”, “Service”) operated by Kompass Education (UK) Limited (“we”, “us”, “our”), a company registered in England and Wales.

By accessing or using our Platform, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Service.

2. Definitions

  • “User” means any individual who accesses or uses the Platform
  • “Content” means courses, materials, videos, and other educational resources
  • “Account” means your registered user account on the Platform
  • “Subscription” means a paid membership plan providing access to Content

3. Account Registration

To access certain features of the Platform, you must create an Account. You agree to:

  • Provide accurate and complete registration information
  • Maintain the security of your Account credentials
  • Notify us immediately of any unauthorised access to your Account
  • Accept responsibility for all activities under your Account

You must be at least 18 years old to create an Account. By registering, you confirm that you meet this age requirement.

4. Use of the Platform

4.1 Permitted Use

You may use the Platform for your personal, non-commercial educational purposes in accordance with these Terms.

4.2 Prohibited Conduct

You agree not to:

  • Share your Account credentials with others
  • Copy, reproduce, or redistribute our Content without permission
  • Use automated systems to access the Platform
  • Attempt to circumvent security measures
  • Upload malicious code or interfere with Platform operations
  • Use the Platform for any unlawful purpose
  • Harass, abuse, or harm other users

5. Subscriptions and Payments

5.1 Billing

Subscriptions are billed in advance on a recurring basis (monthly or annually) depending on your selected plan. Payment is processed through our secure payment provider, Stripe.

5.2 Automatic Renewal

Subscriptions automatically renew unless cancelled before the renewal date. You can cancel your Subscription at any time through your Account settings.

5.3 Refunds

We offer refunds in accordance with UK consumer law. If you are a consumer, you have the right to cancel within 14 days of purchase for a full refund, provided you have not accessed any Content. For digital content, once you begin accessing Content, you acknowledge that you lose your right of withdrawal.

5.4 Price Changes

We reserve the right to change Subscription prices. Any price changes will be communicated to you in advance and will apply from your next billing cycle.

6. Intellectual Property

6.1 Our Content

All Content on the Platform, including courses, videos, text, graphics, and software, is owned by us or our licensors and is protected by copyright, trademark, and other intellectual property laws.

6.2 Limited Licence

We grant you a limited, non-exclusive, non-transferable licence to access and view Content for your personal educational use during your Subscription period.

6.3 User Content

If you submit content to the Platform (such as reviews or comments), you grant us a worldwide, royalty-free licence to use, display, and distribute such content in connection with the Platform.

7. AI Features

Our Platform includes AI-powered features such as the AI Mentor. These features are provided for educational assistance only. AI-generated responses should not be relied upon as professional advice. We do not guarantee the accuracy or completeness of AI-generated content.

8. Limitation of Liability

To the fullest extent permitted by law:

  • We provide the Platform “as is” without warranties of any kind
  • We are not liable for any indirect, incidental, or consequential damages
  • Our total liability shall not exceed the amount you paid for your Subscription in the 12 months preceding the claim

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

9. Consumer Rights

If you are a consumer in the United Kingdom, you have certain statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. Nothing in these Terms affects your statutory rights.

10. Termination

We may suspend or terminate your Account if you breach these Terms. Upon termination, your right to access the Platform and Content ceases immediately. You may terminate your Account at any time through your Account settings.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the Platform. Your continued use of the Platform after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales. If you are a consumer, you may also have the right to bring proceedings in your country of residence.
